Discord Gets Sued Over Alleged Anti-Consumer Practices

The plaintiffs claim the platform has intentionally made it overly difficult to cancel subscriptions.

Last week, messaging and communication platform Discord got hit with a class-action lawsuit over its alleged anti-consumer business practices, with the plaintiffs claiming that the platform has deliberately made canceling its Nitro subscriptions as challenging and counter-intuitive as possible.

First spotlighted by Lawyer Rob Freund, the lawsuit claims that Discord has violated California's Business and Professions Code by forcing users to jump through hoops to cancel their subscriptions. Referencing Section 17602 of the code, the allegation points out that there is no "prominently located direct link or button" in the user settings to facilitate subscription cancellation.

Instead, the lawsuit continues, "A user is required to navigate to the 'Subscriptions' tab within the user settings and then locate the small 'Cancel' button. After clicking the 'Cancel' button, Discord then presents the user with a series of prompts to click through in order to cancel the subscription, including prompts which are seemingly designed to convince the user to not cancel their subscription."

According to the plaintiffs, "This is hardly a 'timely and easy-to-use mechanism for cancellation,' nor a cancellation procedure that allows the consumer to cancel 'without engaging any further steps that obstruct or delay the consumer's ability to terminate the automatic renewal or continuous service immediately."

The lawsuit also highlighted the numerous YouTube tutorials on how to cancel Nitro as additional evidence of "Discord's cancellation flow" being "obfuscated."

Earlier this year, Adobe was sued by the US Department of Justice over the same issue, with allegations that the company has been harming its users by automatically enrolling them in its default subscription plan without clearly disclosing key terms related to the cancellation process, making it incredibly difficult to cancel. The lawsuit also accused Adobe of burying the key terms of its APM plan "in fine print and behind optional textboxes and hyperlinks," ensuring that most consumers would never notice them.

At the moment, Discord hasn't officially addressed the accusations on its social media pages or blog, so it remains to be seen whether the issue will be resolved at the state level or escalate and go federal, potentially involving the DOJ once again like in the Adobe case.

    You think that's bad. Uber one cannot be cancelled near the monthly payment day, you get a notification to say your payment will be taken about 3 days before, you realise you still didn't cancel from last time, you then go to cancel and get told you can't because it's too close to your payment day. Probably on the hope you forget until they next tell you. But then I actually think this illegal.

    Me, im more concerned that their cs/support reps apparently are entirely unable to reset passwords, or even manually replace a hash. Paid for my account for a year thinking I'd be able to go back to it.. NOPE. Mandatory password change (didn't ask for that) and since i don't have access to my email anymore, FAa.. OH WAIT. I was a member before 2FA.. NEVER SAID I NEEDED TO SET IT UP! Think they cared about ANY of it? Nah. Despite screenshots of me logged in talking to a friend, who was willing to tell them I'm also me.. apparently despite working at discord they're completely inept when it comes to any type of large-scale systems. I mean who tells their customers they can't actually change their password without access to their email? I tried to explain it to em. But either they're actually talked to lie there.. Or they're literally too stupid to code a light bulb change. I haven't even done admin work in 20 years and *i* know a few ways to do it. So yeah that doesn't surprise me. I mean odds are it's been easy to cancel the account for a long time but once you actually click the button the employee who gets it can't figure out how. 😁😂

    You can manage it on mobile by going to goigle chrome, making your tab page as desktop site on Discord .com/shop and then from there you can access the subscriptions page wirhout needing a PC. Hope this helps people!

    So many people defending that the cancel button was magically able to be found. If that was the case, I would have unsubscribed months ago. When I did try to find a way to cancel, I spent hours trying to figure it out, gave up and kept the subscription going until they double charged me twice in the SAME month. After the double charge  I finally figured out how to cancel which from the get go should have been easier to do from the jump. I shouldn't have to jump through hoops just to access a feature where I can cancel a subscription if needed and yes, I was also trying to be convinced to change my mind and keep the subscription going. When I press cancel subscription, I don't want to see "are you sure you really want to cancel your nitro"? Uh duh. That's why I'm here. These other fuck turds are the reason why developers of apps and games get away with shit. Sometimes I wish fixing stupid was a easy task but unfortunately it is not.

    You can't manage or cancel the subscription in the mobile app, it tells you to open the desktop client to cancel the subscription.

    What the fuck kind of bullshit is that?

    let's not forget that Adobe CHARGES you a fee regardless of when you cancel a subscription, which is IMMENSELY predatory and unnecessary.

    It's not difficult, you just go to billing settings, manage nitro, then click cancel. It shows what benefits of nitro you had and will lose by canceling and the only button that's colored is the cancel button. Imo it's harder to find the nevermind keep nitro button

    I've never had issues with cancelling my subscription.  Perhaps it's the age difference - or the fact no one actually keeps up with things the way they should.  I'll have my team on it, as this is news to me.
